Recovery of money and civil suits

Legal notices, summary suits, commercial suits and recovery of dues.

Whether it is a personal loan, unpaid invoices or money due under an agreement, the civil law offers clear routes to recover it.

Step by step

  1. Gather proof: agreements, invoices, bank transfers, and messages acknowledging the debt.
  2. Send a legal notice demanding payment within a set time.
  3. Choose the right suit: a summary suit under Order XXXVII CPC for claims based on written contracts, bills, promissory notes or cheques; a commercial suit for commercial disputes of ₹3 lakh or more (usually after pre-institution mediation); or an ordinary recovery suit.

Time limits

Most money claims must be filed within 3 years under the Limitation Act, 1963. A written acknowledgement of the debt or a part payment can extend this period.
